1. Agreement and provider
These Terms of Use (“Terms”) are a binding agreement between you and Ökte Çilmi (“Tru,” “we,” “us,” or “our”), the provider of the Tru application and related services (together, the “Service”). By downloading, accessing, creating an account, or using the Service, you agree to these Terms and the Privacy Policy. If you do not agree, do not use Tru.
You must be at least 13 years old to use Tru. If the law where you live requires a higher minimum age or parental consent, that requirement applies. If you are not old enough to agree on your own, a parent or legal guardian must review and accept these Terms for you and is responsible for your use.
If you use Tru on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes that organization. Tru is intended for personal learning unless we agree otherwise in writing.
2. The Tru service
Tru helps readers learn a language through books. Features may include a reading library, personal book import, contextual definitions and translations, pronunciation and audio tools, saved vocabulary, review exercises, notes, highlights, goals, progress, and reminders. Some features may require an account, an internet connection, compatible system capabilities, or a paid plan.
The availability and behavior of a feature may vary by language, book, country, account status, device compatibility, and applicable rights. We may add, modify, limit, or remove features when reasonably necessary for product, legal, security, or operational reasons. We do not promise that every title, language, feature, or result will always be available.
3. Your licence to use Tru
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use Tru for lawful, non-commercial purposes on devices you own or control, as permitted by the applicable app marketplace rules.
Except where applicable law gives you a non-waivable right, you may not copy, rent, lease, sell, sublicense, distribute, publicly perform, modify, create derivative works from, reverse engineer, decompile, attempt to discover source code, or circumvent access controls relating to Tru. This licence does not transfer ownership of Tru or any included content.
4. Accounts and account security
You agree to provide accurate information, keep it current, protect your sign-in credentials, and promptly notify us if you suspect unauthorized access. You are responsible for activity under your account except to the extent caused by our failure to use reasonable care. You may not impersonate another person, create an account for someone without authority, transfer an account, or use another person's account without permission.
You can request deletion of your account and associated information from the account controls in Tru, or by emailing hello@learnwithtru.com from the email associated with your account. We may require reasonable verification. Removing the app does not necessarily delete an account or cancel a marketplace subscription.
5. Books and other content you provide
“Your Content” means books, images, profile information, notes, highlights, bookmarks, word lists, and other material you choose to add, save, or create through Tru. You keep ownership of Your Content. You grant us a limited, non-exclusive, worldwide licence to host, copy, transmit, display back to you, adapt for compatibility, and otherwise process Your Content only as reasonably necessary to provide, protect, support, and comply with law for the Service. This licence ends when the relevant content is deleted, except for temporary backups and records we are legally permitted or required to retain.
You may add a book or other material only if you own it, it is in the public domain where you use it, or you otherwise have the legal right to use it through Tru. You represent that Your Content and our permitted use of it do not violate law or another person's intellectual-property, privacy, publicity, confidentiality, contractual, or other rights. Personal import does not grant a right to publish, distribute, or share a work.
We may reject, remove, or restrict Your Content if we reasonably believe it violates these Terms, creates a security or legal risk, infringes rights, or is incompatible with the Service. If you believe content available through Tru infringes your rights, email hello@learnwithtru.com with your contact details, identification of the protected work or right, the content at issue, and the basis for your claim.
6. Tru and catalog content
Tru's software, interface, branding, illustrations, and original materials are owned by us or our licensors and are protected by intellectual-property law. Books, covers, fonts, audio, images, and other catalog materials may be owned by their respective rights holders, licensed for use, or available under public-domain or open-licence rules. Their inclusion does not transfer ownership or grant rights beyond those stated by the applicable licence and these Terms.
You may use catalog content only within Tru for personal purposes unless the applicable rights holder or licence expressly permits more. Attribution and open-source notices, where required, may be provided in the app or alongside the relevant material.
7. Language and learning results
Definitions, translations, examples, pronunciations, audio, proficiency estimates, recommendations, and exercises may be incomplete, inaccurate, or unsuitable for a particular context.
Tru is an educational aid, not a certified translation service or a substitute for professional judgment. Check important language with a reliable source or qualified person. Do not rely on Tru for legal, medical, financial, safety, immigration, or other high-stakes advice. We do not guarantee a particular exam score, proficiency level, learning speed, vocabulary size, fluency result, or educational outcome.
8. Acceptable use
You must not use, or help another person use, Tru to:
- violate law, a court order, these Terms, or another person's rights;
- upload unlawful, infringing, deceptive, abusive, exploitative, malicious, or privacy-invasive material;
- gain unauthorized access to an account, content, system, or non-public part of the Service;
- interfere with, damage, overload, disrupt, or evade limits protecting the Service or its users;
- introduce malware or code intended to compromise a device, account, or service;
- scrape, crawl, bulk-download, automate, or systematically extract the Service or its content without written permission, except where law expressly permits;
- resell, sublicense, publicly distribute, or commercially exploit Tru or its content without permission; or
- misrepresent affiliation with Tru or use our marks in a way likely to confuse others.
Good-faith security reports may be sent privately to hello@learnwithtru.com. Nothing in these Terms restricts conduct that applicable law expressly allows and that cannot be waived by contract.
9. Free features, paid features, and subscriptions
Tru offers free and paid features. The price, currency, billing period, included features, trial terms, renewal terms, and cancellation method shown before purchase form part of these Terms. A charge is made only after you confirm it through the app marketplace. The marketplace processes payment and may apply its own billing and refund terms.
Unless the purchase screen states otherwise, subscriptions renew automatically for the stated period until cancelled at least 24 hours before the end of the current period. You can manage or cancel a subscription through the marketplace account used to purchase it. Deleting the app or your Tru account does not itself cancel a subscription; cancelling a subscription does not itself delete your Tru account.
We may change future prices or plan features with the notice required by law and marketplace rules. A price change will not take effect for an existing subscription without any required notice or consent. Refunds are handled by the marketplace except where applicable law requires us to provide a remedy. Nothing in this section limits mandatory consumer rights.
10. Privacy and third-party services
The Privacy Policy explains how Tru handles personal information. The Service may rely on or link to third-party products, content, licences, or services. We do not control third-party sites and are not responsible for their independent content, availability, or practices. Separate third-party terms may apply to your use of those services.
11. Availability and changes
We aim to provide a reliable experience, but Tru may occasionally be interrupted, delayed, changed, or unavailable. We may perform maintenance, address security or legal issues, impose reasonable usage limits, or discontinue all or part of the Service. Where reasonably possible and legally required, we will provide notice of a material change or discontinuation.
You are responsible for maintaining compatible equipment, software, connectivity, and backups of content you cannot afford to lose. We are not responsible for changes made by app marketplaces, rights holders, network providers, or other third parties outside our control.
12. Suspension and termination
You may stop using Tru at any time. We may investigate, limit, suspend, or terminate access if reasonably necessary to address a material breach, security incident, credible rights complaint, legal requirement, abusive conduct, non-payment, or risk to Tru, users, or others. For a remediable issue, we will ordinarily provide notice and a reasonable opportunity to correct it unless delay would create harm or law prevents notice.
When this agreement ends, your licence to use Tru ends. Sections that by their nature should survive—including ownership, responsibility for content, accrued payment obligations, disclaimers, liability limits, dispute terms, and general provisions—will continue to apply.
13. Additional terms for Apple users
These Terms are between you and Ökte Çilmi, not Apple. Apple is not responsible for Tru or its content. Your licence is limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, including any applicable family-sharing rules.
We, not Apple, are responsible for maintenance and support required by applicable law, product and consumer claims, legal compliance, and investigation of claims that Tru infringes third-party intellectual-property rights. Apple has no obligation to provide maintenance or support. If Tru fails to conform to an applicable warranty, you may notify Apple; Apple may refund any purchase price paid for the app, and, to the maximum extent permitted by law, Apple has no other warranty obligation.
You must comply with applicable third-party agreement terms. You represent that you are not located in a country subject to a United States government embargo and are not on a United States government prohibited or restricted-party list. You may not export or re-export Tru except as authorized by applicable law.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce this section against you. Where Apple's standard terms govern, the Apple Licensed Application End User License Agreement also applies.
14. Disclaimers
To the maximum extent permitted by law, Tru is provided “as is” and “as available.” We disclaim implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, quiet enjoyment, non-infringement, and accuracy. We do not warrant that Tru will always be uninterrupted or error-free, that every book or feature will remain available, that content or learning results will be accurate, or that data will never be lost.
These disclaimers do not exclude an express promise made in writing or any warranty, remedy, or statutory right that applicable law does not allow us to exclude.
15. Limitation of liability
To the maximum extent permitted by law, neither Tru nor its licensors will be liable for indirect, incidental, special, exemplary, punitive, or consequential loss, or for loss of profit, revenue, opportunity, goodwill, or data, arising from or relating to the Service, even if advised that such loss was possible.
To the maximum extent permitted by law, our total aggregate liability for claims relating to Tru will not exceed the greater of the amount you paid for Tru during the 12 months before the event giving rise to the claim or US$50 in local-currency equivalent. These limits do not apply to liability that cannot lawfully be limited, including fraud, wilful misconduct, death or personal injury caused by negligence, or violation of non-waivable consumer rights.
16. Indemnity
To the extent permitted by law, if you use Tru for business purposes or on behalf of an organization, you will indemnify and hold Tru harmless from third-party claims, losses, and reasonable costs arising from Your Content, your violation of these Terms, or your infringement of another person's rights. This section does not apply to individual consumers where prohibited by law.
17. Governing law and disputes
These Terms are governed by the laws of Türkiye, without regard to conflict-of-law rules. If you are a consumer, this choice does not deprive you of mandatory protection under the law of your habitual residence, and you may bring a claim before any court or consumer authority with mandatory jurisdiction. Before formal proceedings, either party may contact the other and attempt in good faith to resolve the dispute informally.
18. General terms
If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remainder will stay effective. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign them in connection with a reorganization or transfer of Tru, provided your mandatory rights are preserved. These Terms, the Privacy Policy, any applicable notices, and purchase terms shown before a transaction form the entire agreement about the Service.
19. Changes to these Terms
We may update these Terms to reflect changes to Tru, law, or our practices. We will post the revised version, update the date above, and provide additional notice where required. If a change materially reduces your rights, it will apply prospectively after any required notice or consent. If you do not agree to updated Terms, you should stop using Tru.
